Investigative Committee of the Russian Federation “answered” a report about the crime committed by a citizen Vladimir Zhirinovsky

At the end of October 2013 after spectaculat in its cynicism, racist speech of Mr. VV Zhirinovsky, showed by the TV channel “Russia 1”, the Chair of the Investigative Committee of the Russian Federation Alexander Bastrykin was sent a Crime Incident Report. Inisiator of the report Aslan Beshto drew attention of Mr. Chairman RF IC for public extremist calls of Mr. Zhirinovsky to restrict the constitutional rights of Russian citizens on the grounds of nationality, ie to discrimination against national minorities.

October 24, 2013 as part of the television program “Duel” on state channel “Russia 1” multi-million audience watched as the leader of the Liberal Democratic Party, vice – speaker of the State Duma of the Federal Assembly of the Russian Federation Vladimir Zhirinovsky, not mincing his words, suggested to limit births in North Caucasus, applying penalties for every third child as well as to surround the North Caucasus by barbed wire and limit the freedom of movement of Russian citizens living in the North Caucasus.

At the same time, Doctor of Philosophy and Distinguished Lawyer of Russia seems to have forgotten that the North Caucasus republics are the territory of Russia, and the people of these republics – its full-fledged citizens. In his speech Zhirinovsky VV proposed restriction of constitutional rights for citizens of the Russian Federation, guided solely by criteria of their nationality, origin or religion. In particular, during his speech he said:

“Terror walks the planet and hurts Russia with its nasty wing. reason – the territory of the North Caucasus, the reason – Islamic radicalism. We need to take control of the North Caucasus, provide a state of emergency, send troops there, the police, the FSB. But the main reason – the excess population. The terror will not lose while there is no birth control, until there is no more than 2 children in the family, it is necessary to control the birth rate. ”

“… They have to bear as many children as humanity gives birth to on the average – two, one – that’s it! Penalty for the third one! They do not want it? – Limit them! They do not want it? – Surround them by barbed wire! They do not want it? – Lock everything you can. Let them stay there. ”

“Terror is inevitable wherever there is excess population. The most effective way, it is also not something we came up with but the whole world – to lay the blame for the attack on the family. This may be the destruction of property where they lived (the family) and criminal punishment for the whole family … Make the family responsible! They raised her for thirty years, she became a terrorist, now let them be responsible and destroy their houses! ”

“Too much population is the reason of terrorism in Caucasus…

Limit the birthrate in the North Caucasus! Without this, no measures will help and they will keep killing Russian for another hundred years.”

With his short but emotional and meaningful statement made in the course of the television program “Duel”, Vladimir Zhirinovsky committed gross violations, as a minimum of the following international and domestic regulations:

4 . Declaration of the Rights of the Child of 20 November 1959 adopted by the United Nations.
5 . Declaration on the Elimination of All Forms of Racial Discrimination of 20 November 1963 , adopted by the United Nations : Articles 2, 9, 11.
6. International Convention on the Elimination of All Forms of Racial Discrimination of 21 December 1965, adopted by the States Parties to the Convention : Art. Art. 2-7.
7. Declaration on the Elimination of All Forms of Intolerance and of Discrimination Based on Religion or Belief of 25 November 1981 , adopted by the United Nations.
8. Shanghai Convention on Combating Terrorism, Separatism and Extremism of 15 June 2001 .
9. RF Constitution , Art. Art. 19, 27, 38.
10 . The Federal Law ” On the Status member of the Federation Council and the status of deputies of the State Duma of the Russian Federation”: Art. 9.
11. Federal Law “On Countering Extremist Activities” : Art. Art. 14 , 15.

According to the art. 1 of  Federal Law as of 25 July 2002 № 114-FL «On Countering Extremist Activities», extremist activities (extremism) – are (including):

– Inciting social, racial, national or religious hatred;
– Violation of the rights, freedoms and legitimate interests of citizens depending on the social, racial, national, religious or linguistic affiliation or religion.

However, the vice-speaker of the State Duma of the Russian Federation is not bothered by the fact that, in accordance with Art. 280 of the Criminal Code, public appeals for extremist activity committed with the use of the mass media are a criminal offense.

In accordance with Art. 282 of the RF Penal Code, any action aimed at inciting hatred or enmity, as well as the humiliation of a person or group of persons on grounds of sex, race, nationality, language, origin, religion, or membership of a particular social group, committed publicly or through the media, are also punishable offense .

In the words of Vladimir Zhirinovsky absolutely obvious is direct intent of committing these crimes. Being well-educated man, Honored Lawyer of Russia, Vladimir Zhirinovsky was fully aware of the illegality of his actions. Moreover, he couldn’t not foresee the possibility of negative consequences of his statements, but wanted these consequences to occure. He is well aware that interethnic relations are a cornerstone of Russian reality. He also understood that many of his voters like the incitement of ethnic hatred and help him score political points.

I believe that these actions of Vladimir Zhirinovsky contain elements of crimes under Article 280 of the Criminal Code of the Russian Federation: Public calls for extremist activities, as well as Article 282 of the Russian Criminal Code: inciting hatred or hostility, and humiliation of human dignity.

Based on the above within your powers I urge you to verify the statements of Vladimir Zhirinovsky as of October 24, 2013 in the program “Duel” in accordance with Art. 144 Code of Criminal Procedure and if there are grounds to initiate against Zhirinovsky VV criminal proceedings in accordance with Art. 145 of the Code
